3. Subscription and Enterprise Services

ReefDiary offers both free and paid subscription tiers, including Enterprise plans for aquarium shops and service professionals. Subscription fees, features, and limits are described on our pricing pages. Payments are non-refundable unless otherwise stated or required by applicable law. We reserve the right to modify our pricing with reasonable notice.

4. Acceptable Use

You agree not to use the Services to:

Violate any local, state, national, or international law or regulation.
Infringe upon the rights of others, including intellectual property rights.
Transmit unauthorized or unsolicited advertising or promotional materials.

You retain all rights to the data, photos, and information you log and upload to ReefDiary ("User Content"). However, by uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process this content strictly for the purpose of operating, improving, and providing the Services to you.

The Services, including their original content, features, design, and functionality, are owned by ReefDiary and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7. Disclaimers and Limitations of Liability

No Warranty: The Services are provided "as is" and "as available" without any warranties of any kind. We do not guarantee that the Services will be uninterrupted, error-free, or completely secure.

Limitation of Liability: To the maximum extent permitted by law, ReefDiary shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Services or any damage to your aquarium livestock resulting from decisions made using our tools.

8. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ReefDiary is legally established, without regard to its conflict of law provisions.

We reserve the right to modify these Terms at any time. We will notify users of significant changes by email or through a notice in the App. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes.
